Mortgage Institutions Act

An Act to make provisions for establishment and licensing of mortgage institutions to grant loans and advance to individuals for the purchase or construction of a dwelling house; improvement or extension of an existing dwelling house; and to accept savings and deposits from members of the public and to pay interest thereon. This act provides for the licensing of mortgage institutions and lays down rules for mortgage business by licensed mortgage institutions. If any company intends to carry on mortgage business in Nigeria, it shall apply in writing through the Federal Mortgage Bank to the Minister for the grant of a licence in accordance with the following provisions of this act. Every mortgage institution shall submit to the Federal Mortgage Bank such returns as specified. The Federal High Court shall have jurisdiction to try all offences created under this act.

National Environmental Protection (Management of Solid and Hazardous Wastes) Regulations.

The objectives of solid and hazardous waste management are to identify solid, toxic and extremely hazardous wastes dangerous to public health and the environment and provide guidelines necessary to establish a system of proper record keeping, sampling and labelling of dangerous and extremely hazardous wastes. Regulation 20 provides for the notification of discharge of waste. It is stated that the Agency shall instruct the person responsible for the spillage or discharge to clean up all released dangerous harmful wastes or hazardous substances within the time or days as may be specified, designate and treat, store or dispose of all solids, water or other materials contaminated by the spillage or discharge in accordance with specific directives given in that behalf by the agency or any person or authority authorised in that behalf to issue the directive and restore the area affected by the spillage or discharge and replenish resources in a manner acceptable to the Agency or any other person or authority authorised in that behalf by the Agency.

Federal Lands Registry (Miscellaneous Provisions) Act.

This is an Act to provide for the establishment of the Federal Lands Registry to register all titles to Federal Government lands and for matters connected therewith. The regulation 10 provides the power of the Minister to give directives. It states that the Minister may give to the registry directives of a general character or relating generally to particular matters with regard to the registry or its functions under this act and it shall be the duty of the registry to comply with such directives.

Federal Mortgage Bank Of Nigeria Act

This is an Act to establish the Federal Mortgage Bank of Nigeria to provide long-term credit facilities to mortgage institutions in Nigeria and encourage and promote the development of mortgage institutions at the rural, local, state and federal levels. This act provides for the establishment of Federal Mortgage Bank of Nigeria and its board of directors. The functions of the mortgage bank shall be to, among other things: (a) provide long-term credit facilities to mortgage institutions in Nigeria at such rates and such terms as may be determined by the board in accordance with the policy directed by the Federal Government, being rates and terms designed to enable the mortgage institutions to grant comparable facilities to Nigerian individuals desiring to acquire houses of their own; (b) license and encourage the emergence and growth of the required number of viable secondary mortgage institutions to service the need of housing delivery in all parts of Nigeria; (c) encourage and promote the development of mortgage institutions at rural, local, state and federal levels; (d) supervise and control the activities of mortgage institutions in Nigeria.

This is an Act to establish the Federal School of Surveying to provide courses of instruction and training in surveying, cartography, photograph, lithography, hydrography and other related courses and to make provisions for related matters. It establishes the Federal School of Surveying. Some of the functions of the School shall be to provide courses of instruction, training and research in surveying, cartography, photography, lithography, hydrography, photogrammetry, remote sensing and other related courses, produce technical, professional and such other skilled personnel, normally required for surveying and mapping duties and provide specialised professional training for registration as surveyors.

This is an Act to make provision for flags to be worn by Nigerian ships other than those of the Nigerian Navy or Naval Reserve as evidence of Nigerian nationality, on all lawful occasions to be classed as ensigns and to be distinguished by their respective colours; and for other matters connected therewith. The regulations provides that the Minister of Transport may as respects the blue and the red ensigns, but not otherwise, make regulations prescribing) recommended proportions for the ensigns, appropriate to the size of the ship, special occasions on which the blue ensign may be worn by ships not owned by any of the governments of Nigeria, and the form of warrant of authority with reference to the wearing of the blue ensign.

This is an Act to establish a council known as The Raw Materials Research and Development Council to develop local raw materials and co-ordinate research efforts especially in relation to raw materials acquisition, exploitation, conservation and development. The functions of the Council shall be to draw up policy guidelines and action programmes on raw materials acquisition, exploitation and development) to review from time to time, raw material resources availability and utilisation with a view to advising the Federal Government on the strategic implication of depletion, conservation or stock-piling of such resources, to encourage publicity of research findings and other information relevant to local sourcing of industries etc.

Town Planners (Registration, Etc.) Act

This is an act to establish the Town Planners’ Registration Council for the registration of town planners and to provide extensively for the regulation of the profession of town planning. The tribunal shall consist of the President of the Council and eleven other members of the Council appointed by The Council and shall include three members of The Council holding office by virtue of paragraph (b) of section 1 (3) of this Act or, where the number of those members is for the time being less than three, all those members.

This is an Act to provide for the furnishing to the director of Federal Surveys of Information relating to survey work to provide for the carrying out of certain additional operations, by persons doing the work and for purposes connected with the matters. It emphasizes no survey work within the meaning of this act shall be carried out unless the person responsible for carrying out the work has given to the director of federal surveys (in this act referred to as “the director”), not less than three months then next preceding the day on which the work commences, or such shorter period as the director may allow, notice of the work in accordance with the provisions of this Act.

Quantity Surveyors (Disciplinary Committee) Rules

These rules, made under paragraph 2 of the second schedule of the Quantity Surveyors (registration, etc.) Act, provides with respect to proceedings and other matters in cases against practitioners referred to the Quantity Surveyors Disciplinary Committee by the registered quantity surveyors investigating panel. In any case where in pursuance of section 12 (3) of the Act the panel is of the opinion that a prima facie case is shown against a practitioner, the panel shall prepare a report of the case and formulate any appropriate charge or charges and forward them to the secretary. The rules also concern the composition of the committee.

This is an Act to establish the Quantity Surveyors’ Registration Board of Nigeria and to provide for the registration of quantity surveyors; determine the standard of knowledge and skill to be obtained by a person seeking registration and matters connected therewith. This act establishes The Quantity Surveyors’ Registration Board of Nigeria as a body corporate and defines its functions and powers. It also provides for registration of quantity surveyors by the board and establishes the disciplinary committee and the registered quantity surveyors investigating panel. The committee shall be charged with the duty of considering and determining any case referred to it by the panel. The act also defines penalties for unprofessional conduct and grants regulation-making powers to the minister.

Copra (Inspection for Export) Regulations.

These regulations provide rules for the storage, sealing, packing, handling and inspection of copra destined for exportation. Where copra inspected, graded, sealed and marked for export by the Produce Inspection Service of any State is delivered at any port for shipment, officers of the Federal Produce Inspection Service shall conduct check-tests on the batch. Copra lots may be condemned or be made subject to treatment by fumigation.

It provides for the re-sealing of probates and letters of administration granted in commonwealth countries and a state of Nigeria. The act defines conditions to be fulfilled before re-sealing and effects of re-sealing.

It states that they shall spread a parcel of 100 bags of coffee evenly on a clean tarpaulin spread on the ground or on a clean firm and cemented surface) take at random or in an indiscriminate manner, a representative sample, and out of this he shall draw a final sample weighing 710.23 Kilograms, and spread this final sample on a clean smooth surface, preferably on a table which has no cracks or crevices but not on a concrete floor or on an empty bag.

Produce (Enforcement Of Export Standards) Act

An Act to make provision for the inspection of commodities for export from Nigeria at ports of shipment, for the purpose of enforcement of grades and standards of quality in respect of such commodities, and for matters incidental to the execution of the powers conferred by this act. It establishes The Produce Inspection Board and provides for the control of produce destined for exportation. The act shall apply to the produce described in the first schedule to this act. The board shall have advisory functions towards the Minister and states of The Federation. The act also empowers the Minister to make emergency orders for the control in Lagos of pests affecting produce. Where any produce is found within Lagos to be infested or suspected to be infested with any pest, a produce officer may make such order as he may deem necessary for the treatment of such pest. The act also defines wrongful grading of produce to be an offence.

Pest Control of Produce (Special Powers) Act.

This is an Act to provide for the inspection of produce for pests before export at all sea and airports in Nigeria and other matters ancillary thereto. It defines powers of inspection and enforcement of any person specially authorized by the Minister of commerce as a pest control inspector of produce. Power of entry conferred by this act shall include the power to fumigate for the purpose of eradicating or controlling pest infestation of produce and the power of condemnation of produce. The act also defines the offence of obstruction of inspectors and grants powers to the Minister to make regulations generally for the purposes of this act in consultation with the Produce Inspection Board.
